1. Acceptance of Terms

By accessing or using NolaBloom (the “Service”), operated by Malaki Dynasty LLC (“NolaBloom,” “we,” “us,” or “our”), a Delaware limited liability company with its registered address at 1007 N Orange St, 4th Fl 5050, Wilmington, DE 19801, United States, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

NolaBloom provides AI-generated relationship insights, personality analysis, and related content based on information you provide through our quiz and platform. The Service is intended for entertainment, self-reflection, and informational purposes only.

NolaBloom is NOT a substitute for professional medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment. AI-generated content may contain errors and should not be relied upon as professional guidance. If you are experiencing a mental health crisis, please contact a licensed professional or emergency services in your country.

3. Eligibility

You must be at least 18 years old to use the Service. By using NolaBloom, you represent and warrant that you meet this requirement.

4. Account Registration

You may be required to provide an email address and other information to access certain features. You agree to provide accurate information and keep it up to date.

5. Subscription, Trial, and Billing

• NolaBloom offers an introductory paid trial: $9.99 USD for 3 days (“Trial”).
• Unless cancelled before the end of the Trial, your subscription automatically converts to a recurring monthly subscription billed at $19.99 USD per month(or the price displayed at checkout) (“Subscription”).
• There is no minimum commitment. You may cancel at any time; cancellation takes effect at the end of the current billing period, with no further charges.
• Your Subscription renews automatically each month until cancelled. By subscribing, you authorize us (via our payment processor) to charge your payment method on a recurring basis.
• Prices may change with at least 30 days’ notice. Continued use after a price change constitutes acceptance of the new price.
• EU/UK consumers: see Section 7 and our Refund Policy regarding your statutory right of withdrawal.

6. Cancellation

You may cancel your Trial or Subscription at any time via your account settings or by contacting support@nolabloom.com. Cancellation takes effect at the end of the current billing period. You will not be charged for subsequent periods. No partial refunds are issued for the current period except as set out in our Refund Policy.

7. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. If you are located in the European Union or United Kingdom, you also benefit from a statutory right of withdrawal as described in that policy.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or resell the Service
• Submit information about another person without their consent
• Use the Service to harass, defame, or harm others

9. Intellectual Property

All content, branding, software, and AI outputs provided through the Service are owned by or licensed to NolaBloom and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.

10. AI-Generated Content Disclaimer

Reports, insights, and recommendations are generated using artificial intelligence based on the information you provide. They are probabilistic in nature, may not be accurate, complete, or applicable to your specific situation, and are provided for entertainment and informational purposes only.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, NolaBloom and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless NolaBloom from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Dispute Resolution and Arbitration

Any dispute arising from these Terms shall first be addressed informally by contacting support@nolabloom.com. If unresolved within 30 days, the dispute shall be resolved through binding individual arbitration, and you waive any right to participate in a class action.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

17. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, including for violation of these Terms.
